RIFLE, Colo. — Nearly two years after a gay teen suffered serious injuries while drunk, it remains unclear whether Kyle Skyock was beaten or accidentally injured, according to the Denver Post. An attorney for Skyock withdrew a demand for criminal charges in the case, but another lawyer for Skyock and a coalition of gay groups are pressing ahead with a civil lawsuit. Skyock, 18, became a poster boy in the push for state hate crime legislation after he was found unconscious at the bottom of a steep embankment along a highway on Feb. 11, 2001. Skyock's blood alcohol was above the legal limit for intoxication and his blood tested positive for marijuana. A forensic pathologist examined Skyock twice and determined that Skyock sustained injuries from falling. Seven months after the incident, Skyock gave police a detailed description of being beaten by four youths yelling gay epithets and wielding a bat. The district attorney's investigation showed Skyock's injuries were not consistent with that account.
